AHMEDABAD: The Gujarat high court on Tuesday came down heavily on residents of Shree Bhavani Cooperative Housing Society in Vejalpur over unauthorized construction and ordered the Ahmedabad Municipal Corporation to undertake inspection and take action against against encroachers at the earliest and report back to the court.
The case involves one Ramila Makwana, who assured the court four years ago that she would demolish construction illegally put up by her family. When the HC ordered the family last week to remove the construction, which cannot be regularised under GDCR rules, AMC officials insisted on the removal and the family approached the HC on Monday. Two women of the family broke down in the courtroom.
This led the court to issue the family a stern warning to not indulge in emotional expression to move the court. The bench of Justice J B Pardiwala and Justice V D Nanavati said that the family took everything for granted, including the high court. The judges sent out a clear message to the society, “Crying and wailing before the court hardly matters. It will never weigh, and will not waver the court. The court is expected to follow the law and ask any citizen to comply with the law. The judiciary must not take on the colouration of whatever may be popular at the moment. The high court is a guardian of rights and we have to tell people things that they often don’t like to hear. No man is above the law and no man is below it; nor do we ask for any man’s permission when we ask any man to obey the law. It is demanded as a right and not as a favour.”
The high court granted the petitioner one last chance to apply to the AMC for regularization of her house. The court came to know that many houses in the society, which were constructed when the area was not part of AMC, were built in violation of law. The high court expressed shock at the illegal construction and ordered the AMC to undertake a survey and inspection of the society “and if it is found that entire society is unauthorized, action should be taken at the earliest and reported to the court.”
The HC made it clear that it should not happen that only one particular house is targeted and others go scot free. “The law will apply to all. If other bungalows are unauthorized, they should be demolished,” the court said. photo 

અમદાવાદ: ગુજરાત હાઈકોર્ટે મંગળવારે વેજલપુરમાં શ્રી ભવાની કોઓપરેટિવ હાઉસિંગ સોસાયટીના રહેવાસીઓ પર અનધિકૃત બાંધકામને લઈને ભારે ઠપકો આપ્યો હતો અને અમદાવાદ મ્યુનિસિપલ કોર્પોરેશનને વહેલી તકે તપાસ હાથ ધરવા અને અતિક્રમણ કરનારાઓ સામે પગલાં લેવા અને કોર્ટમાં રિપોર્ટ કરવાનો આદેશ આપ્યો હતો.
આ કેસમાં એક રમીલા મકવાણાનો સમાવેશ થાય છે, જેમણે ચાર વર્ષ પહેલા કોર્ટને ખાતરી આપી હતી કે તે તેના પરિવાર દ્વારા ગેરકાયદેસર રીતે મુકવામાં આવેલ બાંધકામ તોડી પાડશે. જ્યારે HCએ ગયા અઠવાડિયે પરિવારને બાંધકામ દૂર કરવાનો આદેશ આપ્યો હતો, જે GDCR નિયમો હેઠળ નિયમિત કરી શકાતું નથી, ત્યારે AMC અધિકારીઓએ હટાવવાનો આગ્રહ કર્યો અને પરિવારે સોમવારે HCનો સંપર્ક કર્યો. પરિવારની બે મહિલાઓ કોર્ટરૂમમાં તૂટી પડી હતી.
આના કારણે કોર્ટે પરિવારને કોર્ટમાં જવા માટે ભાવનાત્મક અભિવ્યક્તિમાં સામેલ ન થવા માટે કડક ચેતવણી આપી હતી. જસ્ટિસ જેબી પારડીવાલા અને જસ્ટિસ વી ડી નાણાવટીની ખંડપીઠે કહ્યું કે પરિવારે હાઈકોર્ટ સહિત તમામ બાબતોને માની લીધી છે. ન્યાયાધીશોએ સમાજને સ્પષ્ટ સંદેશો પાઠવ્યો, “કોર્ટ સમક્ષ રડવું અને વિલાપ કરવો ભાગ્યે જ મહત્વપૂર્ણ છે. તે ક્યારેય તોલશે નહીં, અને કોર્ટને ડગમગશે નહીં. અદાલત કાયદાનું પાલન કરે અને કોઈપણ નાગરિકને કાયદાનું પાલન કરવાનું કહે તેવી અપેક્ષા રાખવામાં આવે છે. ન્યાયતંત્રે આ ક્ષણે ગમે તેટલી લોકપ્રિયતાનો રંગ ન લેવો જોઈએ. હાઈકોર્ટ અધિકારોની રક્ષક છે અને અમારે લોકોને એવી બાબતો જણાવવી પડશે જે તેઓ વારંવાર સાંભળવા માંગતા નથી. કોઈ માણસ કાયદાથી ઉપર નથી અને કોઈ માણસ તેનાથી નીચે નથી; કે જ્યારે અમે કોઈ પણ માણસને કાયદાનું પાલન કરવાનું કહીએ ત્યારે અમે કોઈ માણસની પરવાનગી માગતા નથી. તેની તરફેણ તરીકે નહીં પણ અધિકાર તરીકે માંગ કરવામાં આવે છે.
હાઈકોર્ટે અરજદારને તેના ઘરને નિયમિત કરવા માટે AMCને અરજી કરવાની છેલ્લી તક આપી. કોર્ટને જાણવા મળ્યું કે સોસાયટીના ઘણા મકાનો, જે એએમસીનો ભાગ ન હતા ત્યારે બાંધવામાં આવ્યા હતા, તે કાયદાનું ઉલ્લંઘન કરીને બનાવવામાં આવ્યા હતા. હાઈકોર્ટે ગેરકાયદે બાંધકામ પર આઘાત વ્યક્ત કર્યો હતો અને AMCને સોસાયટીનું સર્વેક્ષણ અને નિરીક્ષણ હાથ ધરવા આદેશ આપ્યો હતો "અને જો એવું જણાય કે આખી સોસાયટી અનધિકૃત છે, તો વહેલી તકે પગલાં લેવા જોઈએ અને કોર્ટને જાણ કરવી જોઈએ."
હાઈકોર્ટે સ્પષ્ટ કર્યું કે એવું ન થવું જોઈએ કે માત્ર એક જ ઘરને નિશાન બનાવવામાં આવે અને અન્ય લોકો મુક્ત થઈ જાય. “કાયદો બધાને લાગુ પડશે. જો અન્ય બંગલા અનધિકૃત છે, તો તેને તોડી પાડવા જોઈએ," કોર્ટે કહ્યું.
